Why Lessees should not pay partial rent payments?

Lease Agreement Default

A Lessee pays a partial rent payment is a Lease Agreement default because the Lease Agreement terms state otherwise. The Lessee's partial payment initiates a late rent payment charge if the remaining balance is after the due date.

Owners do not, or should not, accept payments for rent not equal to the full payment of rent due.

In the event of court proceedings, A Judge may use state statues or decisions made by other Judges having similar cases. The Judge may subjectively decide on the merits of each party's actions and evidence because the owner decides to accept a partial payment inconsistent with the Lease Agreement terms. An owner's actions may infer a change of the original terms of that Lease Agreement.

Letter of Understating if more than one Lessee

Lessees should write a Letter of Understanding and contribute to a household account equal to two (2) months rent and averaged utilities. This type of letter and account alleviates stress from another Lessee's emergency expense or loss of income.

One Full Payment One Consistent Method

Lessees experience a greater success of completing timely payments if paid in full days before the due date, and if mailed, in one envelope. We recommend mailing the envelope more than seven (7) days before the due date in case of a mail disruption. A mail disruption does not waive the late rent payment charge if postmarked after due date and the date on the check or money order is irrelevant.
